ARTICLE 1: GENERAL AND COORDINATED PRINCIPLES OF THE CONTROLLER
1.1. The non-profit association Wallonia Belgium Tourism, in short WBT, headquartered at 1000 Brussels, rue Marché aux Herbes, 25-27 and whose registered office is at 5000 Namur, Avenue Comte de Smet de Nayer, 14, registered at the ECB under number 0888,366,085, (hereafter referred to as WBT) operates a website walloniabelgiumtourism.co.uk (hereafter referred to the ‘site’).
1.2. WBT is responsible for the processing of personal data (hereafter referred to as ‘data’) that we collect during your visit to the site and and based on your use of it.
1.3. All the personal data we collect is processed in accordance with Belgian and European regulations applicable to the protection of personal data, in particular regulation (EU) 2016/679 of the European Parliament and Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46/EC (general Regulation on data protection, "RGPD"), Directive 2002/58/EC, as amended by Directive 2009/136/EC and the law of 13 June 2005 known as the Electronic Communications Act, as amended by the law of 10 July 2012.
ARTICLE 2 – SCOPE OF APPLICATION
2.1. The Charter describes the steps taken to operate and manage your data when using the site and your rights as a user of the site.
2.2. The Charter is applicable to all services offered by WBT via the site.
ARTICLE 3: DATA THAT CAN BE COLLECTED
3.1. When you visit our site, we may be required to collect information (including data) in several ways:
3.1.1 Data provided by the users.
We collect the data you provide on the site for the purpose of allowing WBT and its partners to provide you with information to visit Wallonia by, inter alia, sending by mail general or targeted newsletters or responding to any other general or specific request. We will use the information you shared with us for affinity marketing purposes via targeted advertising on a variety of social media platforms (Google, Facebook…). This aims at communicating offers and news most suited to your needs and expectations.
3.1.2 Information gathered via technology tools.
3.2. WBT draws your attention to the fact that by visiting our site, WBT has a legitimate interest in collecting and processing your data and by communicating your data, you enter into a contract with WBT. As the data provided is necessary for this agreement to come into force, you acknowledge that WBT may process your data in accordance with the terms described in this Charter.
If you do not wish to enter into a contract with WBT, or to use the features of the site to communicate your data directly, and if you do not want WBT to collect and process your data relating to your browsing of the site, do not use the site.
ARTICLE 4: FINAL DATA PROCESSING
4.1. The data we collect, store and process are used for the following purposes:
I. General Public
To inform you via our newsletters, general or targeted, for the target consumer or business, whether the visits are individuals or groups, tourism initiatives in Wallonia, discount vouchers or promotional offers, guidebooks or brochures about tourist sites, tourist activities and tours, tourist accommodation, tourist events, games or contests related to tourism, our communication campaigns, our media campaigns, restaurants, bars, cafés, festive places at tourist sites, welcome centres for tourists for the preparation and organisation of their excursions and stays in Wallonia, congress or seminar centres, organisations of tourism professionals, advice before you go to Wallonia, experiences of tourists in Wallonia, feedback on their experiences, etc.
To participate in our online competitions (via our external platform, our website and our social networks) or offline (on our stands at events such as trade shows, fairs, tourist events, etc.)
To carry out satisfaction surveys, statistical analysis, market research, measurements of the experience of the users of our digital tools and any other measure of our performance.
4° Tourist Information
To respond to requests for information and reservations.
5° Order Brochure
To allow you to download, consult or receive a tourist brochure at your home.
6° Commercial offers
To keep you informed of commercial offers, discounts and promotions of Walloon tourist operators.
II. Tourism Professionals
1° Data update
To update the data of public and private tourist operators with regard to their practical information, their contact details, their prices, their equipment, their services etc.
To take feedback from back office personnel.
3. Promotional actions
To structure and develop tourism, offer new products, promote editions, web sites, paper and digital documents presenting touristic offers, distribute said documents, carry out actions to promote tourism especially with our media partners.
III. General public and professionals
Development To improve the services we offer you by informing us about your interests in the features, performance and support of our services.
4.2. However, we may not send to our non-professional users electronic information regarding the use of the site (via newsletter) as well as our promotional offers unless these users have explicitly consented to it.
ARTICLE 5: COMMUNICATION TO THIRD PARTIES
5.1. We regard personal data as confidential information.
We will pass data to third parties only under the conditions specified in this Charter.
5.2. The following are considered to be partners of WBT:
- All regional authorities and bodies exercising their normal activities
- All bodies in the tourism, cultural and HoReCa Federation (hereafter known as ‘Partners’. In this context, we can communicate to our partners your data, to fulfil the purposes outlined in Article 4.1.
5.3. We may also disclose your data if necessary to (a) comply with applicable laws or comply with an order or injunction from courts or tribunals, or (b) to protect and defend our rights or those of the users of the site.
5.4. We may send your data to our direct marketing partners by email if you choose to receive our promotional communications. In any event, we will take all reasonable steps to ensure that these companies comply with this Charter. Our policy is to prohibit these companies from using your data for any purpose other than to provide the products and/or services expressly requested by WBT.
5.5. We can ‘anonymise’ data by removing personally identifiable items such as name and email address, and group data for use in market research or other business purposes. We can then be obliged to disclose this anonymised information to third parties.
5.6. Our site may contain links to third party sites, and some of our services give you access to third party services (such as social networks). However, we do not have control over how third party sites and services deal with the personal data that you provide to them. We are not responsible for these third party sites and services or their privacy practices. We therefore refer you to the data protection declarations of the third party sites or services to which you access from our sites or services.
5.7. We can also use this data to carry out research into how to improve our services.
ARTICLE 6: RIGHT OF OBJECTION
6.1. You have the right to object to the processing of your data as well as to their use for the purposes of promotion, especially commercial. 6.2 To unsubscribe to our newsletters, you can exercise your right by clicking on the unsubscribe link located at the bottom of each newsletter. Unsubscribe requests are only effective if a message confirms it. Alternatively, you may exercise your right of objection as described in Section 6.1 of this Charter.
ARTICLE 7: RIGHT OF ACCESS, RECTIFICATION, DELETION AND LIMITATION OF TREATMENT
7.1. You have the right to access, rectification, deletion and limitation of the processing of your data, in accordance with articles 15, 16, 17 and 18 of the RGPD.

7.3. Before you answer a request, we can invite you to identify yourself.
ARTICLE 8: RIGHT OF PORTABILITY
You also have the right to receive data that concerns you and that you have provided to WBT in a structured format, commonly used and machine- readable. And the right to transmit this data to another controller when the treatment has been automatically processed.

In order to ensure the protection of the data we collect, we have set up a programme to secure the information stored in our system. In addition, our IT system has a new generation software protection device.
ARTICLE 11: DATA RETENTION
WBT will be able to keep your data for the duration as long as is necessary to complete our intended purposes (CFR point 4.)
ARTICLE 12: RIGHT OF COMPLAINT
Without prejudice to any other administrative or judicial remedies, you have the right to lodge a claim with a supervisory authority, in particular in the Member State of your habitual residence, place of work or place of the alleged violation if you consider that the processing of your data violates the RGPD.
